The justice system should be there to help &#8211; not make it harder.<\/p>\n\n\n\n<p>B.C. is making changes to the Family Law Act to make it work better for families in B.C. The Family Law Act Modernization project is working now to identify and propose changes to update outdated provisions, fill gaps or add clarification for more consistent interpretation.<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/11025_00\" target=\"_blank\" rel=\"noreferrer noopener\">Family Law Act<\/a>&nbsp;(FLA) is B.C.\u2019s primary statute for families going through separation and divorce. The statute:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Places the safety and best interests of children first<\/li>\n\n\n\n<li>Encourages families to resolve their disputes outside of court<\/li>\n\n\n\n<li>Addresses family violence<\/li>\n\n\n\n<li>Clarifies parental responsibilities<\/li>\n\n\n\n<li>Clarifies the division of property<\/li>\n<\/ul>\n\n\n\n<p>Phase 1 of the FLA Modernization project included a review of the division of property and pensions, as well as spousal support provisions.<\/p>\n\n\n\n<p>Phase 2 of the FLA Modernization project included a review of provisions about:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Guardianship, parenting arrangements and contact<\/li>\n\n\n\n<li>Relocation of a child<\/li>\n\n\n\n<li>Child-centred decision making<\/li>\n\n\n\n<li>Children\u2019s views and parenting assessments and reports<\/li>\n\n\n\n<li>Family violence and protection orders<\/li>\n<\/ul>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"phase-2\">Phase 2<\/h2>\n\n\n\n<p>Phase 2 included a technical discussion paper with information and questions about family law and the family justice system. There were also four surveys for anyone who wished to provide feedback based on lived experience with these topics. Engagement for this phase was open January 11 to April 30, 2024.<\/p>\n\n\n\n<p>Phase 2 also includes a policy intentions paper, which details the ministry\u2019s intended policy recommendations based on our research and analysis of Phase 2 engagement feedback. A public consultation on the division of pensions under the FLA was conducted through the British Columbia Law Institute and the resulting report is published on <a href=\"https:\/\/www.bcli.org\/project\/pension-division-review-project\/\" title=\"\">their website<\/a>.<\/p>\n\n\n\n<p>These engagements informed <a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/bills\/billscurrent\/4th42nd:gov17-1\">Spring 2023 amendments<\/a> to the Family Law Act. Through these changes, the B.C. government clarified the law around companion animals, property, and pensions to better meet the modern-day needs of separating couples. \u00a0<\/p>\n\n\n\n<p>The ministry is involved in ongoing discussions with Indigenous Peoples regarding the division of property that has Indigenous cultural significance when spouses separate.<\/p>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Related engagements<\/h2>\n\n\n<div class=\"related-engagements\">\n                                    <div class=\"govtogether-engagement-card\" aria-label=\"Engagement title: Community Advisory Group on Extortion.
