Background
The Mineral Tenure Act and related regulations set out BC’s laws on mineral tenure (i.e. the system for registering and maintaining mineral claims and leases)
- The Mineral Tenure Act governs who can register claims; statutory mineral rights granted by claims; where claim registration can occur; the system for claim registration; and the powers and duties of statutory decision makers
- Currently there is a “free entry” system – meaning applicants who receive a “free miner certificate” can stake claims to minerals on most private and Crown land in BC
- Claims are “staked” online on an interactive map – and the claim holder gets the statutory rights to the minerals inside the boundaries of that claim
